Construction Company Accused of Fraud

The two owners of a Deerfield Beach construction company have been arrested along with four other men and charged with racketeering and fraud for allegedly attempting to avoid mandatory workers’ compensation insurance premiums and payroll taxes over several years. They’re accused of participating in a scheme through Richard & Rice Construction LLC using more than 20 shell companies to hide their actual number of employees. The Broward County Sheriff’s Office said that while this pattern may have appeared to put the company in compliance with workers’ compensation insurance requirements, it also allowed Richard & Rice to bid lower on contracts. The company is accused of gaining over $17 million in profits this way.

Workers’ compensation insurance is mandatory in Florida

Florida law requires an employer in the construction industry with one or more employees to carry workers’ compensation insurance. That insurance covers any accidental injuries or occupational diseases that arise in the course and scope of employment in the construction industry by an anticipated and foreseeable risk. The general rule is that if an employee is injured on the job, workers’ compensation benefits are that employee’s sole and exclusive remedy for compensation. Unless it was intentional, workers’ compensation benefits are payable even if the employee caused the accident himself. If the accident is caused by a third party, the injured employee can elect to accept workers’ compensation benefits at the same time he or she is pursuing an independent lawsuit against that third party.
