Coral Springs Workplace Injury Attorney
A Coral Springs construction worker was hospitalized last week after a 60 foot long 7,000 pound pipe to be used on a road project fell on to his right leg. He is a sub-contractor who was working on the Sawgrass Expressway improvement project. Paramedics rushed to the scene and stabilized the victim. He was then transported to Coral Springs Medical Center and is now in guarded condition. The doctors are hopeful however that they can save his leg.
The Workers’ Compensation Exclusive Remedy
Florida Workers’ Compensation Law requires nearly all employers to cover their employees with Florida Workers’ Compensation Benefits, which covers lost wages and medical treatment. As such, the general rule is that upon being hurt in the course and scope of the job, Florida Workers’ Compensation is an employee’s sole and exclusive remedy, meaning they cannot have a jury trial and sue for pain and suffering, among other things. Basically, Florida Workers’ Compensation Benefits covers an employee even if it was his or her own fault!
Third Party Liability
Sometimes another corporation may be responsible for the worker’s injuries. If true, the employee can try to bring forth a personal injury lawsuit. This is known as third party tort claim. In fact, these type of cases can be pursued at the same time that an injured employee is receiving Florida Workers’ Compensation Benefits.
