A 40-year-old road construction worker remains hospitalized and on a respirator after being struck by a car that was apparently trying to avoid another vehicle on Interstate 95 near Lauderhill. The Florida Highway Patrol reports that they are looking for that second care that might have played a role in that crash. After the impact, the vehicle that hit the employee remained at the scene, but the other possible at fault driver fled the scene. The victim was airlifted with multiple fractures and internal bleeding. He has since undergone surgery, and unfortunately, future surgeries are expected. Undoubtedly, he’ll miss a lot of time from work.
Workers’ Compensation
When an employee is injured during the course and scope of his or her employment, that person is eligible for benefits under Florida’s Workers’ Compensation law. Ordinarily, workers’ compensation benefits are the sole and exclusive remedy of a person who is injured on the job, but in this case, the worker’s severe injuries were also in fact caused by a third party or parties.
Third Party Liability or Personal Injury Case
When an employee is hurt on the job, workers’ compensation benefits might not be sufficient to fully compensate that individual for the damages that he or she suffered. Lauderhill Workers’ Compensation lawyer Evan M. Ostfeld, Esquire advises that there is an exception to that rule when a worker is injured by a third party defendant(s) like in this case. Florida law allows the injured employee to bring a personal injury claim directly against the owner of the at fault vehicle along with the driver who caused the crash, while also receiving workers’ compensation benefits. Any recoveries from these negligent parties might therefore help the injured worker financially. Fortunately Evan’s law firm can handle both portions of such a case for your convenience.
