Worker Injured In Wood Chipper Accident

A landscaper suffered traumatic injuries when his arm was pulled into a wood chipper, according to Palm Beach County Fire Rescue. The man was taken to Delray Medical Center suffering from what witnesses called a significant injury. The injuries to the landscaper come just weeks after Hernan Gutierrez, who had just begun working for his company, died when he was pulled entirely into a wood chipper.

Florida Workers’ Compensation Law
The Florida Division of Workers’ Compensation and Coral Springs worker compensation injury attorneys say that the state of Florida requires non-construction industry companies with four or more part or full-time employees to obtain workers’ compensation coverage. Companies in the construction industry must provide workers’ compensation coverage if they have one or more part or full-time employees. In addition, out-of-state employers who have more than one or more part- or full-time employees performing work in Florida must also provide workers’ compensation insurance ( For more information on Florida Workers Compensation Law ). Florida also requires that employers report any workplace fatalities to the Division of Workers’ Compensation within 24 hours via phone, fax or email and to file the claim administrator First Report of Injury. Failure to obtain workers’ compensation coverage for employees can result in fines as well as Stop-Work Orders that require employers to cease operations.
Victim and Family
In the case of the most recent wood chipper incident, the man whose arm was severely injured is entitled to workers’ compensation which covers any injury that arises “out of and in the course of their employment.” Because the gentleman was working as a landscaper at the time of his injury, he is entitled to recover costs for his medical treatment and lost wages. If the injury occurred due to faulty equipment or lack of safety features, he may also be entitled to compensation for pain and suffering.
