Supreme Court Rejects Football Players Workers’ Compensation Case

An appeal for workers’ compensation benefits made to the Florida Supreme Court on behalf of a former Arena Football League (AFL) player was rejected. The case involved an injuries suffered in July 2013 by Byron Bishop, a former Area Football League lineman for the Orlando Predators.

Bishop had been injured in the midst of his quest to make a comeback with the team but he suffered multiple injuries during a team workout. The Judge of Compensation Claims initially awarded the football player benefits. Unfortunately the First District Court of Appeal and later the Florida Supreme Court held that Mr. Bishop was not entitled to workers’ compensation benefits based on a simple technicality. Apparently, the basis for rejecting the workers’ compensation claim was tied to the fact that although he signed a contract with his particular team, the league never did thus rendering it invalid. That’s because in contrast to the National Football League’s (NFL) policy of an individual player signing a contract with a specific team, the AFL itself is considered the actual employer.

Losing workers’ compensation claims can be devastating. That is why hiring a Coral Springs Workers’ Compensation makes so much sense. Evan M. Ostfeld and his staff have extensive experience in this particular area. Their team approach will improve your chances against the “Big Bad Insurance Companies”, e.g. F.C.CI. Travelers, Claims Center, The Hartford, Amerisure, Amtrust, CNA and the like.

There can be any number of injuries suffered by employees in all fields, with the status of workers at the time of an injury sometimes resulting in conflict over proper compensation. Such funds can be in the form of lost wages, medical treatment or even a lump-sum tax-free settlement. Without such legal assistance, an injured worker might be denied the justice.
