Why Employee’s Should Know About Workers’ Compensation

Coral Springs residents need help when it comes to injuries that occur on the job. Many workers sadly are unaware of the complexity of the workers’ compensation system. This lack of knowledge causes many injured employees to go unheard when they experience a workplace accident. Frankly, the process is quite cumbersome and intimidating. As such, oftentimes people just give up their rights! Don’t let that happen to you; knowledge is power.

Many reasons exist as to why some injured workers receive denials when they apply for workers’ compensation benefits. One such example is that some employers do not classify their employees’ jobs properly. Only an employee (not an independent contractor) is eligible for workers’ compensation benefits. That being said, many unscrupulous companies intentionally alter their payroll schemes in order to save money on their insurance workers’ compensation premiums. After an on-the-job injury occurs, the boss simply tells the worker who was just hurt, “Sorry Charlie, but since you are an independent contractor, unfortunately you are not covered under the law”. The employee then believes that they have no case. A lawyer like Evan M. Ostfeld, Esq. and his legal team however can help uncover if the employer is trying to commit insurance fraud. If so, you still may be entitled to receive your workers’ compensation benefits.

As an aside, in order for an injured employee to receive lost wages due to an accident, a hospital and or an authorized workers’ compensation physician must state either that the employee cannot work at all or place them on a restricted work status which describes their restrictions. If the job cannot accommodate those limitations, the workers’ compensation insurance carrier must commence payment of the wages.

Whatever the reason for the denial, the injured worker still has the right to fight for medical care and lost wages. The individual should therefore speak to a workers’ compensation attorney early on to obtain assistance and before its’ too late.
