Bayer Advances Toward Resolving Roundup Litigation

Bayer AG is finally ready to draft terms of a settlement with many law firms across the U.S. that represent tens of thousands of people. All of the plaintiffs claim that the weed killer Roundup causes cancer. According to some of those more familiar with this matter, this move is pushing the Roundup litigation closer to its final decision.

There are six primary firms acting on behalf of several smaller firms who are in turn representing a host of plaintiffs, according to those in the know. Bayer is trying to keep its Roundup product on the shelf while also ending this Roundup litigation that has greatly damaged the company’s shares after the major loss of several trials.

Bayer has been speaking with plaintiffs’ lawyers for weeks discussing a possible settlement that could be worth somewhere around $10 billion, according to The Wall Street Journal who cited those exposed to the matter. An individual reported that the overall deal still seems to be hovering around the large number. However, it’s also been warned that an actual deal hasn’t been agreed to yet. This one could fall apart. Both parties involved are completely free to turn and walk away if the agreements don’t matchup. Bayer has made it clear that protection from litigation in the future is a non-negotiable condition of the settlement.

It’s possible that the parties reach an agreement within the next few weeks, according to people familiar with the case. This would make it easier for Bayer to assuage the nerves of their shareholders before the company’s annual meeting in April. Kenneth Feinberg, the mediator appointed by the court, has said that he remains cautious about this optimism for a settlement to be reached. He also said it would be premature to report a final agreement having been reached.

A spokesperson for Bayer was much more cryptic in their response. They simply said that the discussions were continuing and that no public statements could be made yet about the agreement due to the strict confidentiality of the process.
